<br />?4id-Term Review <br />.4t. Gunnison No. 1 ;4ine <br />Introduction <br />This document presents the results of the Division's mid-term review of West <br />Elk Coal Company's Mt. Gunnison No. 1 Hine. This inid-term review was <br />conducted to fulfill the requirements of Rule 2.08.3, 2.06.2(9), 2.Ob.3(4), <br />2.06.5(3), 2.06.7(5) and 3.02.2(4). <br />Rule 2.08.3 requires that the Division conduct a review of eacn permit issued, <br />prior to its mid-term (2 1/2 years). Based on this review, for good Cause <br />shown, the Division nay require reasonable revision or modification of the <br />permit provisions to ensure compliance with the Act and Regulations. <br />Rules 2.Uci.2, 3, 5 and 7 requires that experimental practices, mountaintop <br />removal variances, variances from AOC, and variances from contemporaneous <br />reclamation be reviewed by the Division where applicable. The Mt. Gunnison <br />permit does not have any operations under these categories. <br />Rule 3.02.2(4) requires that the Division review the amount of the bond and <br />the terns of acceptance of the bond every 2 1/2 years. <br />The mid-tern review consisted of a detailed review of the Mt. Gunnison No. 1 <br />Permit application to identify any items that may have been overlooked during <br />the initial review. Tne Division also reviewed all subsequent revisions and <br />stipulation responses to ensure that all permit commitments and conditions <br />were being followed. Hydrologic monitoring data was reviewed in conjunction <br />with the review of the application to assess the adequacy of the monitoring <br />plan and discussion of hydrologic impacts. Finally, the Division conducted a <br />comprehensive on site inspection of the mine to ensure consistency of the mine <br />plan with field conditions. Problems and observations from past inspection <br />reports were considered while conducting the inspection. <br />This document is organized as follows: Section I includes a summary of our <br />decision to require revisions with regard to the mid-term review required <br />under Rule 2.08.3. Section IA includes a listing by category of what items <br />need to be revised, a rationale for requiring these revisions, and timetables <br />for completing these revisions. Section IB includes an advisory section on <br />items identified furing the review that may need to be considered in future <br />permit terms. Section IC presents a summary of the status of the stipulations <br />attached to the Mt. Gunnison Permit C-007-80 and any revisions required with <br />regard to the stipulations. Finally, Section II presents the results of the <br />bond review required under Rule 3.02.2(4). The responses to items identified <br />in Section IA should be submitted as one package in a format that allows easy <br />insertion into the application by June 1, 1984. The response to our bonding <br />concerns in Section II should be submitted by April 1, 1984. <br />
