Dear Ms. Beville:
Attached is the Division's Mid-Tenn Review and Decision to require revisions
to the Mt. Gunnison 14ine, Permit No. C-007-80. The review was in fulfillment
of Rules 2,08.3, 2.06.2(9), 2.06.3(4), 2.06.5(3), 2.06.7(5), and 3.02.2(4).
The mid-term review primarily consisted of reviewing the permit application,
stipulation responses, revisions, and any supplemental information, as well as
information from field inspections and past inspection reports. The main
purpose of the review was to identify any areas of the permit application that
will need to be revised or modified to ensure compliance and reflect the
current status of the mine.
The attached document contains our mid-terns review, a rationale for requiring
any revisions to the application, timetables for submitting responses, a
summary of the status of stipulations, and the results of our performance bond
review. In addition there is a section that identifies items found during our
review that pertain to future permits. Those items are advisory in nature.
Revisions were found to be needed under the categories of Legal, Financial,
and Compliance Information; Hydrologic Balance; Climatological Information;
Topsoil; Coal Handling Facilities; Underground Development Waste.; Permit Area
Maps; and Bonding. In general, most of the items pose no immediate
environmental concerns, rather they serve to make the mine plan more clear and
concise. Many of the items needing revision are activities that have been
approved under subsequent revisions but need to be incorporated and
consolidated into the narrative and application maps. An example is the
revisions that have been made to the drainage control plan. A few items such
as the Legal, Financial, and Compliance section will need to De updated to
reflect changes since the permit was first issued.
