Res~~rc°s <br />RE: OSM Special Stipulation Number 3, <br />Permit No. .79-177 <br />Gentlemen: <br />The United States Office of Surface Mining and Enforcement in- <br />cluded in its approval of Energy Fuels Corporation's Permit No. 79- <br />177 Special Stipulation Number 3, which states, <br />"The applicant shall provide, by July 14, 1980, <br />statistically valid vegetative information associated <br />with the soil type of the elk calving ground (soil <br />type X8D). The information must include production, <br />cover and diversity of the area. A dissimilarity <br />statistical analysis shall be performed to demonstrate <br />differences between aspen communities on other soil <br />types in the mine plan area and communities on soil <br />type X8D in the mine plan area." <br />This letter constitutes our response to Special Stipulation <br />Number 3, albeit slightly beyond the July 14, 1980, deadline due <br />to a mine holiday from June 28, 1980, to July 14, 1980, during <br />tahich time the mine and office activities were on vacation. Our <br />apologies for the delay. <br />The basis for Special Stipulation Number 3 is explained by <br />OSM in the technical analysis of Section 816.97, wherein it <br />states: <br /> <br />
