Division Director <br />FROM: Joe Dudash ~ ('Vr\\ D <br />RE: Old Gob Pile, OSM Special Focus Oversight Inspection, Bowie No. 1 <br />Mine, Permit No. C-81-038, Bowie Resources Limited. <br />The purpose of this memo is to outline what I have found concerning the history of the <br />designs and certification of the Bowie No. 1 Mine old gob pile. This issue came up during <br />the OSM 1997 Special Focus Oversight inspection of the waste piles at the Bowie No. 1 <br />Mine. OSM wanted the engineer's quarterly inspection certification of the waste piles to <br />state that the piles had been constructed as designed. The West Ridge Waste Pile <br />engineer's certification was changed to reflect this wording. However, the old waste pile <br />certification has not been changed since the pile apparently has not been constructed <br />according to the designs. The following is a summary of what I have been able to <br />decipher: <br />The old gob pile was begun pre-law but has been used post-law; <br />2. The 1981 Findings Document for the original permit application stated that the <br />Division did not want the mine to continue to use the old gob pile since the old gob <br />pile did not comply with the regulations. The Division wanted the operator to start <br />a new gob pile that would comply with the regulations. (See page 38 of the 1981 <br />Findings Document attached to this memo); <br />The Division attached a stipulation to the 1981 Findings Document that allowed <br />the operator to use the old gob pile, with the only regulatory requirement being <br />compaction under Rule 4.10.4(3), until the volume reached 25,000 cubic yards. <br />Once the old gob pile reached 25,000 cubic yards, the old gob pile would have to <br />be brought into compliance with all of the appropriate regulations within 6 months. <br />(See page 39 of the 1981 Findings Document attached to this memo); <br />
