In my review I noted that there has been a discharge from the site into Cash Gulch. It appears <br />to be the Division of Minerals and Geology opinion that the facility can not be operated as a zero discharge facility. <br />The Water Quality Control Division is responsible for ensuring that all dischazges into state waters are permitted <br />and comply with the necessary requirements. We have not found any evidence of a permit being issued to We Gold <br />Hill Mill & Mine. [t appears that any discharge from this site is in violation of the Water Quality Control Act and <br />could be subject to enforcement action and civil penalties. However, the Division is willing to work with you in <br />getting this facility in compliance with all applicable water related regulations. We are requesting that a permit <br />application be submitted by September 1, 1995. If an application is not received, the Division will n:-evaluate our <br />alternatives related to the site. If it is believed by the tympany that a pemlit is not necessary, we would appreciate <br />being notified of the basis for this belief in writing as soon as practicable but by September 1, 1995 at the latest. <br />We would be happy to meet with you to discuss this in more detail.
