<br />SUMMARY <br />The Review Process <br />Mr. Robert Weaver has applied for a permit renewal for the O.C. Mine No. 2 permit. The <br />Division received the permit renewal request on November 20, 1991. This date is 177 days <br />before the expiration of the permit. Rule 2.08.5 requires that the Division receive the <br />application at least 180 days prior to the expiration date to be eligible for the right of <br />successive renewal. Therefore, the O.C. Mine does not have the right of successive renewal. <br />The significance to the O.C. mine is that the permit will expire on the expiration date (May <br />15, 1992) if the Division does not issue a decision. <br />During the renewal review the Division discovered a problem with the mine plan. O.C. has <br />been mining outside the permit boundary. The mine plan maps submitted by the mine show <br />that this has been occurring since 1977. Mining has been confined to a wedge shaped area <br />just north of the current permit boundary. The wedge is bound to the north by a northeast <br />trending fault. Mining in this area currently extends up to 500 feet north of the present <br />permit boundary and encompasses 8.5 acres. <br />The O.C. Mine has been mining this area to comply with a 1972 U.S.G.S. request to <br />mauimize resource utilization. The letter from the U.S.G.S. is presented as the first part of <br />exhibit 13. This letter states that in accordance with Operating Regulations, 30 CFR Part <br />211, Section 54 (b) and (d) the O.C. Mine should mine into the adjacent lease area. The <br />O.C. Mine No. 2 is mining between the abandoned O.C. Mine No.l to the east and the <br />abandoned Nu Mine to the west. The fault is located to the north and the U.S.G.S did not <br />want O.C. to leave a sliver of what would become un-minable coal between the northern <br />mine lease boundary and the fault. Ina 1979 letter to the O.C. Mine, the Office of Surface <br />Mining acknowledged that mining north of the lease area and south of the fault is <br />considered to be an implementation of the previously approved U.S.G.S. mine plan. <br />During the 1981 permit issuance, the O.C. Mine was in the grocers of receiving a B.L.M. <br />lease modification but did not receive it in time for the permit issuance so only a 80 acre <br />area was permitted. O.C. has since received B.L.M. approval but was unaware that they <br />would also need Division approval for the additional 120 acre lease modification area. <br />To remedy the problem, during the review of this renewal, the Division required that the <br />O.C. Mine submit a permit revision to incorporate the 120 acres into the permit. The <br />permit revision is being handled separately from this renewal. This permit renewal will only <br />be for the existing 80 acres. To ensure that the additional 120 acres are incorporated into <br />the existing permit, the following stipulation is attached to the approval of this permit <br />renewal. <br />O.C.
