LIST OF STIPULATIONS Stipulations Nos. 1,2 and 3 were part of the original permit approval on October 29, 1931. Stipulation No. 2 had been incorporated into the permit application during the 1987 renewal. Stipulations Nos. 1 and 3 are continuing and will be carried into the new permit term as stipulations to the approval. Stipulation No. 4 has been added during this permit renewal; a justification for this stipulation is given in the Summary portion of this document. During the 1987 permit renewal Stipulation No. 2 was deleted, and Stipulation No. 3 was renumbered No. 2. In this 1992 renewal, in order to keep the original numbering of the Stipulations, No. 2 will again be No. 3. All stipulations are a binding part of the permit. STIPULATION NO. 1 IF, DURING THE COURSE OF MINING OPERATIONS, PREVIOUSLY UNIDENTIFIED CULTURAL RESOURCES ARE DISCOVERED, THE PERMITTEE SHALL ENSURE THAT THE SITE(S) IS NOT DISTURBED AND SHALL NOTIFY THE REGULATORY AUTHORITY. THE OPERATOR SHALL ENSURE THAT THE RESOURCE(S) IS PROPERLY EVALUATED IN TERMS OF NATIONAL REGISTER ELIGIBILITY CRITERIA (36 CFR 60.6). SHOULD A RESOURCE BE FOUND ELIGIBLE FOR LISTING IN CONSULTATION WITH THE REGULATORY AUTHORITY, THE LAND MANAGING AGENCY (IF THE SITE IS LOCATED ON FEDERAL LANDS) AND THE STATE HISTORIC PRESERVATION OFFICE, THE OPERATOR SHALL CONFER WITH AND OBTAIN THE APPROVAL OF THESE AGENCIES CONCERNING THE DEVELOPMENT AND IMPLEMENTATION OF MITIGATION MEASURES.
