the application. As the post-mining land use, We operator proposes to reclaim the <br />mine site to grazing and wildlife habitat. Information regarding land use can be <br />found on pages 6 and 7 of the permit application. The Division approves the <br />post-mining land use of the operation. It was determined that range land and <br />wildlife habitat meets the requirements of Rule 4.16 for the permit area. <br />(2.07.6(2)(1)). <br />14. Specific approvals have been granted or are proposed. These approvals are <br />addressed in the following section, Section B. (2.07.6(2)(m)). <br />15. The Division finds that the activities proposed by the applicant would not affect the <br />continued existence of endangered or threatened species or result in the destruction <br />or adverse modification of their critical habitats. (2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. <br />As of May 15, 1992, O.C. Mine No. 2, the operator is current in the payment of <br />reclamation fees required by 30 CFR Chapter VII, subchapter R. (2.07.6(2)(0)). <br />SECTION B <br />The following findings and specific approvals are required by Rule 4. <br />I. Roads -Rule 4.03 <br />Access to the mine is by county road. Only two small segments of road, each less than 500 <br />feet in length, were constructed by the operator. No specific approvals are required in this <br />section. These roads meet all the requirements for grade, drainage, and surfacing of 4.03 <br />for access roads. <br />II. Support Facilities -Rule 4.04 <br />A. Construction of support facilities will not result in: the damage, destruction, <br />disruption of oil, gas, or water wells or pipelines, coal slurry <br />pipelines, railroads, or utility lines that pass over, under or through the permit <br />area.
