Information on the sediment control system can be found in Exhibit 8. <br />Water Rights and Replacement <br />The surface water system is designed so that no water rights will be adversely affected by <br />the proposed mining operation. The sediment pond is the only structure that impounds <br />water on the site. The sediment pond will be dewatered within 36 hours following any <br />runoff event thus, any possible down stream users will not be affected. <br />The surface owner at the Nu Mine adit has an absolute decree for up to 0.1 cfs on water <br />leaving the Nu Mine adit. This water right is used for stock watering purposes. The supply <br />of water to this user is dependant upon the water draining from the O.C. Mine No. 2 into <br />the abandoned Nu Mine workings. As a matter of practice, the mine pumps groundwater <br />into interconnecting workings that allows the water to flow to the Nu Mine adit. Therefore, <br />the current operation will not adversely affect the water rights of this user. <br />The only foreseeable adverse effects that the mining operation could have upon water rights <br />holders would be the impoundment of water in the sediment control system or an <br />interference in the discharge of water from the Nu Mine adit. Since the current operation <br />is designed to allow for the flow of water in a manner to avoid injury to water rights holders, <br />there are no anticipated adverse affects on the water rights users in the area. <br />Information on water rights in the area can be found on page 18 and in Exhibit 13 of the <br />permit renewal application. <br />Roads <br />Access to the mine is by county road. Only two small segments of road, each less than 500 <br />feet in length, were constructed by the operator. These roads meet all the requirements for <br />grade, drainage, and surfacing of 4.03 for access roads. <br />Information on roads can be found on page 12 and in Exhibit 9 of the permit renewal <br />application. <br />Coal Waste <br />There are no acid or toxic-forming materials produced at this mine. The underground <br />development waste generated is roof-fall material that is presently disposed of underground. <br />The operator included a plan for an underground development waste pile that is to be used <br />if underground disposal is not possible. As presented in the original permit application, the <br />O.C. Mine No.2 Findings 14 May 15, 1992 <br />
