Schmieding <br />Mined Land Reclamation Division <br />1313 Sherman Street "'~' <br />Room 423 ` `' "~ ~~~ <br />Denver, Colorado 60203 <br />Re: Adams Aggregate operations in the NW1/4 of Section 24, <br />T1S, R67W, 6 P.M.; Parcel 6 <br />Dear Mr. Schmieding: <br />This will confirm our recent telephone conversation in which you <br />advised me that the Division of Mined Land Reclamation had in <br />fact issued a State Permit for gravel mining accessory operations <br />on the above described property, specifically Parcel 6, based <br />upon what the Division deemed to be Adams County approval of <br />such an operation on that site. <br />Please be advised that Adams County has not granted official <br />approval of such an operation with respect to Parcel 6. The <br />existing "authority" for such approval consists solely of a <br />Planning Department letter which indicates that that Department <br />had no objections to such an operation on Parcel 6. As you are <br />aware, however, a county's planning department has no authority <br />to grant final approval of a conditional use. Such approval <br />must issue through a resolution of the Board of County <br />Commissioners. <br />Having advised you of the foregoing, WE RESPECTFULLY DEMAND <br />that you revoke the permit which has issued from your office <br />with respect to Parcel 6. <br />
