XI. Vegetation - Rules 2.04.10, 2.05.4(2)(e) and 4.15

Baseline vegetation information is contained in Section 2.04.10, Exhibit 11
and Map 16 in the MRP. No changes were required in this section since there
will be no surface disturbance in the expanded permit area. The same
vegetative communities found within the existing permit area are found in the
proposed expansion area, in addition to an area of Ponderosa Pine-Douglas Fir
at the western edge of the permit area expansion.
The seed mix to be used during revegetation efforts is found on
page 2.05.4-21. The same seed mix has been used to revegetate the reclaimed
portion of the refuse pile to date.
The original Findings Document contained a stipulation (No. 8) in this
section, requiring submission of a revegetation monitoring plan. The operator
has submitted a plan for monitoring revegetated areas 4, 7, 9, and 10 years
after seeding. Therefore, Stipulation No. 8 is no longer necessary. In
accordance with Rule 2.07.6 (2)(n), the Division finds that the Southfield Mine
operation will not affect the existence of endangered or threatened species or
destroy critical habitat of any such species.
The operation is in compliance with the requirements of this section.
XII. Fish and Wildlife - Rules 2.04.11, 2.05.6(2) and 4.18
Information regarding fish and wildlife is contained in Section 2.04.11 and
Exhibit 12 of the MRP. In response to a request from the operator, the
Division of Wildlife reviewed permit revision materials in regard to potential
impacts on wildlife. The Division of Wildlife concluded that there would be
no significant impacts on wildlife caused by the permit area expansion.
In accordance with Rule 2.07.6(2)(n), the Division finds that the
Southfield Mine operation will not affect the existence of any endangered or
threatened species or destroy critical habitat of any such species.
The operation is in compliance with the requirements of this section.
XIII. Prime farmland - Rules 2.04.12, 2.06.6 and 4.25
There are no changes to this section of the Findings. A prime farmland
investigation is only required for areas of surface disturbance. There will
not be any surface disturbance in the expanded permit area. As a result of
the Prime Farmland Investigation conducted when the mine was originally
permitted, it was determined that no prime farmland exists near the permit
area.
In accordance with Rule 2.07.6(2)(k), the Division finds that no prime
farmland will be affected by the Southfield Mine operation.
The operation is in compliance with the requirements of this section.
-18-
