Introduction <br />This document is the approval package proposed by the Colorado Mined Land <br />Reclamation Division (the Division) for Permit Revision No. 1 for the Peabody <br />Coal Company's Nucla Mine, located in Montrose, County (Figure 1). <br />The original proposed decision and findings of compliance were completed by <br />the Division on April 14, 1983 for purposes of bringing the Nucla Mine into <br />compliance with Colorado Permanent Regulatory Program. Permit C-81-008 was <br />issued on May 26, 1983 for a five-year term, <br />Peabody submitted an application for Permit Revision No. 1 on November 25, <br />1986. The purpose of this revision application was six-fold: <br />1, modify the mine plan to allow for mining in three areas not previously <br />planned to be mined; <br />2. change mining method from draglines to dozers and scrapers; <br />3. modify the mining sequence within the existing permitted mining area; <br />4, modify the sediment control system; <br />5. update the permit application document to include previous revisions and <br />responses to the Division's March 25, 1986 Mid-Term Review; and <br />6. incorporate an additional 6.6 acres to bring the total permitted acreage <br />to 426.6 acres. . <br />The application for this permit revision entailed the submittal of a <br />ten-volume document that is intended to replace in entirety the existing <br />four-volume permit application document. This new ten-volume document <br />includes all aspects of the existing four-volume document plus changes created <br />by previous minor and technical revisions and all information applicable to <br />the permit revision application. <br />The Division has determined it is appropriate to reissue a comprehensive <br />approval package for Permit Revision No. 1. Therefore, this approval package, <br />dated April 2, 1987, replaces in entirety the original pernit approval package <br />when the Division's approval decision becomes final. <br />This new document contains the proposed decision to approve Permit Revision <br />No. 1; a summary which includes a description of the review process, a <br />description of the environment, and a description of the operation and <br />reclamation plan, and the written findings of compliance that the Division is <br />required to make pursuant to the Colorado Surface Coal Mining Reclamation Act <br />of 1979 (CRS 34-33-101 et s~ce ). Detailed infomation about the proposed mining <br />and reclamation operations can be found in the above referenced ten-volume <br />permit application document which is on file in the public record maintained <br />by the Division at its offices and at the Montrose County Courthouse Annex in <br />Nucla, Colorado. <br />-1- <br />
