We have discussed the potential for land application <br />of Hazel-A water, as well as other options. The Division needs to have <br />a proposal for additional contingency measures by the first week of April, <br />1996, and COM, Inc, should schedule deliveries and labor to assure that <br />contingency measures approved by the Division are in place by May 1, 1996. <br />Failure to install appropriate water balance contingency measures by this <br />date will result in a hearing before the Mined Land Reclamation Board for <br />a Notice of Violation. <br />Approval by the Division of Minerals and Geology of the tailing pond spray <br />system, or of any other contingency measures proposed by COM, Inc., does <br />not in any way abrogate the Operator's responsibility to maintain a <br />negative water balance and zero-discharge facility at the Gold Hill Mill. <br />If you have any questions, please contact me. <br />Sinc ~~l/y, <br />Allen C.
