July 13, 2005 <br />La Plata County Commissioners Hand Delivery <br />1060 East Second Avenue <br />Durango, Colorado 81301 <br />RE: Project No. 2002-171 <br />Westside Gravel Pit Class Il <br />Deaz Commissioners: <br />On behalf of Westside Gravel, LLC, request is made for an amendment to the above referenced <br />pernut for additional time to complete the road repair and maintenance on County Road 136 as set forth <br />under the Agreement dated July 17, 2003 between the Commissioners and Westside Gravel for County <br />Road 136. Due to unforseen circumstances, Westside Gravel has not been able to complete those road <br />improvements in a timely fashion. <br />Westside has recently entered into a contract with Consolidated Constructors, Inc. of Farmington, <br />New Mexico to transfer its Class II permit to that company. It has also filed an application for a transfer <br />of its gravel permit with the Colorado Division of Minerals and Geology and it will require their approval <br />and consent. <br />It is my understanding that in order to transfer the permit that the agreement between the BOCC <br />and Westside needs to be amended in order to allow additional time to complete the road repair. <br />Durango PTR Properties, LLC, who is the owner of the property where the gravel pit is located, <br />has entered into a Lease with Consolidated Constructors, Inc. to allow for gravel mining which is <br />contingent upon approval of the transfer of the above permit as well as approval of transfer ofthe Colorado <br />Division of Minerals and Geology permit. <br />Ifyou need anything further, please contact myself or my attorney, Steve Wells at (970) 247-5282, <br />and(or Consolidated Constructors, Inc., Joe Kozimoa~ in Farmington, New Mexico at (505) 326-7771, P. <br />O.
