-63- <br />~,. <br />Stipulation No. 22 ~Y ., <br />THE DIVISION DIRECTS WECC AS A PORTION OF ITS SUBSEQUENT PERMIT <br />APPLICATIONS FOR THE MINE TO SUBMIT A REVISED SUBSIDENCE EVALUATION. <br />THE SUBSIDENCE EVALUATION FOR THE NEXT PERMIT PERIOD SHALL INCORPORATE <br />THE RESULTS OF SUBSIDENCE MONITORING AND THE LANDSLIDES STABILITY <br />STUDIES STIPULATED ABOVE IN DESIGNATED REFINED SAFE AREAS BUFFER <br />BOUNDARIES TO BE OBSERVED IN THE FUTURE MINING BENEATH CRITICAL AREAS, <br />INCLUDING THE DRY FORK OF MINNESOTA CREEK, BEAVER RESERVOIR AND THE <br />LANDSLIDE DEPOSITS ADJOINING IT. THE AMENDED SUBSIDENCE EVALUATION <br />SHALL INCLUDE THE PROPOSAL OF APPROPRIATE SUBSIDENCE MONITORING <br />NETWORKS WIrTHIN EACH OF THESE CRITICAL AREAS. <br />XXIV. Special Categories of Mining other than AVF and Prime Farmland <br />Since this is an underground mine the provisions of mountain top <br />removal, steep slope mining, mining near surface mining and angering do <br />not apply. No in situ processing will be done and the loadout is <br />located within the facilities area. Volume 1, section 3 and Volumes III <br />through VI indicate that the operation is in compliance with this <br />section. <br />XXV. Miscellaneous Compliance (2.05.6, 4.02, 4.12,4.19, 4.21, 4.28, 4.30, ) <br />All requirements under this section have been met by WECC. The <br />operation is found to be in compliance with the requirements of this <br />section. <br />XXVI <br />2.07. <br />XXVII. <br />XXVIII. <br />nd Prohibitions(2.03.7 <br />The Division finds that the operation is not within: 1. An area under <br />study for designation as unsuitable for mining, or 2. An area <br />designated unsuitable for mining. The Division finds <br />that reclamation can be feasibly accomplished.
