. ; -1- <br />August 26, 1985 <br /> <br />PROPOSED DECISION <br />WEST ELK COAL COAL COMPANY <br />Mt Gunnison No. 1 Mine <br />The Colorado Division of Mined Land Reclamation proposes to approve with <br />stipulations an application for a permit revision to increase the permit area <br />by 1,765 acres. This revision application, when originally submitted, <br />entailed adding 1,630 acres to the five year permit area. During the ensuing <br />adequacy review by the Division the applicant proposed to add an additional <br />1.35 acres in order to keep any potential subsidence effects within the newly <br />permitted area. The subsidence angle of draw dictated, therfore, that a total <br />of 1,765 acres be added to the permit. This revision and approval while known <br />as the "1,630 Permit Revision" is for 1,765 acres. <br />This approval decision is based on a finding that the proposed operation will <br />comply with all requirements of the Colorado Surface Coal Mining Reclamation <br />Act, C.R.S. 1973 34-33-101 et. seq., and the Rules promulgated thereunder. <br />The finding of compliance, and the stipulations which are a part of this <br />approval, are attached to this document. <br />The permit revision cannot be issued until all statutory notice and public <br />comment requirements have been satisfied. <br />
