IN ADDITION, THE <br /> OPERATOR SHALL MAINTAIN THE AREA BY <br /> REMOVING EXCESS COAL QUARTERLY. <br />Section V - Variances to the Permit <br />Rules 2.06.2, 2.06.3, 2.06.5 and 2.06.7 require that experimental practices, <br />mountaintop removal variances, variances from approximate original contour <br />(AOC), and variances from contemporaneous reclamation, respectively, be <br />reviewed by the Division where applicable during the Midterm Review. The <br />Eagle Mine does not have any experimental practices or any variances from <br />mountaintop removal or AOC. <br />A variance from contemporaneous reclamation (Rules 2.06.7 and 4.B) was granted <br />for the pit of Williams Fork Strip Mine No. 2 in order for it to serve ae an <br />entrance for a second set of portals into the Eagle No. 9 Mine. In March of <br />1985, the operator ceased mining of the Eagle No. 9 Mine. During the permit <br />revision process of 1987, the Division placed a stipulation on the permit that <br />required the operator to commence reclaiming the Williams Fork Pit. The <br />entire Williams Fork Strip Hine No. 2 was reclaimed by October 15, 1987. <br />Section VI - Undermining of Critical Structures and Renewable Resources Lands <br />Within the life-of-mine plan for the Eagle No. 6 Hine, the applicant projected <br />coal extractions which could potentially subside State Highway 13, the <br />alluvial valley floors of the Yampa and William Fork Rivera, the Colowyo and <br />Cyprus Empire D6RGW railroad spur and an Amoco oil pipeline. Renewal of the <br />permit in 1988, however, did not grant life-of-mine statue to the mine. The <br />Division limited the applicant's mining activity to that area shown on map 24, <br />No. 6 Hine - Mine Plan, for years one through five. Cyprus Empire could not <br />advance beyond those limits without specific approval from the Division. <br />On Auquet 17, 1992, the Division approved technical revision TR-19 permitting <br />Cyprus Empire to conduct developmental mining under Highway 13 and the <br />Williams Fork River and associated alluvial valley floor. The Division did <br />not approve full coal extraction under those lands. The Division can not <br />approve further extraction of coal under the above critical structures and <br />renewable resource lands until the applicant has demonstrated that damage <br />
