\/ <br />Tailing Pond ine <br /> <br />Nilex, Company has been contracted to make the approved <br />repairs. They are scheduled to begin on Tuesday, April 14, <br />and have indicated that the repairs will be completed by the <br />inspection date. <br />We discussed the subject of a game fence. It was agreed by <br />all parties though a game fence was not specifically called <br />for, it was our mutual opinion that a game fence around the <br />tailing pond would protect the liner from future damage. We <br />will begin the fence immediately. The fence cannot be <br />constructed before the inspection date however, we will <br />provide a photo of the fence for the April 22 Board hearing. <br />We all agreed that we would all be better served in the <br />future to keep this kind of communication open. <br />Wayne and I met with Mark Steen and John Henderson on Monday <br />afternoon. I feel confident that we have renewed <br />communications. Mark has agreed it would be valuable for us <br />to meet with your staff prior to the hearing. Mark has also <br />agreed that we should meet with the Boulder County Planning <br />Department staff together. Both co-permittees want the same <br />thing - to run a profitable and environmentally sound <br />operation. <br />Again, my sincere appreciation for your kind attention to <br />these matters.
