I <br />appreciate your efforts in providing detailed and accurate mapping for your q arty and th <br />working towazds meeting the conditions of the approval of your Special Revie This is a <br />benefit to you as the operator, to reviewing agencies and to the public. <br />We believe this product is unique to permitted mines and quarries in Colorado. The use of <br />sequential aerial photogrammetry is in fact the single most important fea re of the <br />approved Special Review. It is the fundamental tool that will serve to ate with <br />unpazalleled accuracy the evolution of the quarry over space and time. <br />Upon examination of the original documents, and given time, the greater val a of tl <br />efforts for everyone's sake will become cleazer. Please understand that r rem; <br />addressing Part 4 are necessary in that the use of aerial photographs are key o both <br />regulatory and quarry management of the property where the deposit cannot <br />systematically and methodically predicted or extracted. <br />With the number and type of items to be completed prior to operation, it woul be helpful <br />to you and to County staff (Health, Engineering and Planning) to do a brief sit inspection <br />prior to beginning operations. When conditions have been completed, please co tact me so <br />that we can arrange such a visit. <br /> <br />We agree. It may prove worthwhile to perform such an inspection in conc rt with the <br />Colorado Division of Minerals and Geology. We think more dialogue betty the State <br />and County may prove clarifying [o all involved as to where the jurisdictional Ines form. <br />This is not to malign County authority, but by clarifying it respective to the Sta e, it would <br />aid in overall communications. <br />remain uncertain as to how well the Planning Department understands the elationship <br />the DMG Permit to the Special Review, as well as the distinct technical com onents and <br />rposes related to each. Compounded by broad and general County guideline relative to <br />;Special Review, the Findings and Resolution, and respective changes made t the State <br />gel, the lines between State and County authority remain blurred as they pe ain to the <br />ecial Review and Planning oversight and enforcement. <br />Our position is that the County has little or no authority on the property wher issues are <br />under the authority of the State or Federal government. Any issues regazdin drainage, <br />originating on-site, are pertinent to the County as it leaves the site. The same for traffic, <br />access, and similar issues. <br />Finally, without diminishing their importance, we do no[ understand how then periphe <br />issues should be considered just cause to continue to restrict our operations and prevent <br />from effecting the changes expressed in the approved Special Review, the appr ved Dr <br />Conversion Permit, and the approved DMG Technical Revision.
