Corley, Jr. <br />Page 2 <br />mation activities of the Division and its reclamation contractor. <br />This letter is to notify you that any further physical interfer- <br />ence by you with these reclamation activities is unacceptable. <br />If you continue to interfere with reclamation efforts, the Divi- <br />sion has directed me to take whatever steps are legally necessary <br />to cause you to cease and desist such interference, and I will do <br />this if it becomes necessary. <br />Obviously, this office, the Division, and the MLRB would <br />prefer to work with you in the reclamation of this area. My ex- <br />perience at the pre-bid meeting at which MLRB member Maxine <br />Stewart was present, is that both the Division and the MLRB have <br />been doing everything possible to work with you on the recla- <br />mation of this site. Moreover, I understand that you commented <br />on the proposed reclamation plan, that your comments were seri- <br />ously considered by the Division and, where appropriate, incorpo- <br />rated into the reclamation plan. Now that the plan has been fi- <br />nalized, the contract for reclamation entered, and the recla- <br />mation activities begun, it is counter-productive for you to tell <br />the contractor and the Division how to do their respective jobs. <br />The MLRB, the Division, and this office wish to continue to <br />work with you to reclaim this site but this is not possible when <br />you are interfering with work activities. I understand that Di- <br />vision representatives are willing to meet with you on a bi- <br />weekly basis to ensure that any concerns you may have about the <br />reclamation are being addressed. This would appear to be a more <br />constructive way for you to make any comments and discuss with <br />the Division your concerns. If you are interested in pursuing <br />this approach, please contact John Nelson at (303) 866-3567, to <br />establish a schedule and meeting location. <br />Please be assured that this office, the Division and the <br />MLRB intend to have this site reclaimed in a timely and satisfac- <br />tory manner, according to the Act, its implementing regulations, <br />and the contract for reclamation entered by the Division. Howev- <br />er, this cannot occur if ,you continue to physically interfere <br />with reclamation activities at the site. <br />
