Canany <br /> Division Director <br /> Natural Resource Trustee <br />Re: Formal Public Hearin ,Appeal of Division Determ' at/on of Designated Mining Operation Status for the <br />Following Permitted Mines: M-1977-306, JD-9 Min~7-31Q JD-6 Mine, M-1978-116, SM-18 Mine, and <br />M-1984-014, JD-8 Mine. <br />Dear Mc Williams: <br />The Colorado Division of Minerals and Geology (DMG) has received Cotter's Notice of Appeal for the <br />Division's July 27rh, 2005 determination that the above referenced mines meet the definition of a Designated <br />Mining Operation per Rule 7.2. Cotter's Notice of Appeal received on August 26'h, 2005 is in accordance with <br />Rule 7.2.4(6). Cotter requested on September 2id, 2005 that it be granted an extension to scheduling of the appeal <br />in order to conduct hydrological study and modeling of the areas in question. The Division has received notice <br />that the study and modeling is complete. <br />Therefore, staff has scheduled the matter for Formal Public Hearing before the Colorado Mined Land <br />Reclamation Board, for consideration. The hearing will be held in Room 318. 1313 Sherman Street. Denver. <br />Colorado, beginning at 10:00 a.m. on November 16`h or 17`h commencing at 10:00 a.m. or as soon thereafter as the <br />matter can be considered.
