I am sorry to be late in <br />responding to that letter, but as you are aware, the Federal Government has been closed <br />down for much of the interval since we received the letter. However, we had previously (see <br />our letter of January 5, 1995, to Mr. Steven Meier), advised the Department of Planning and <br />Development that according to our records a small portion of the land involved was public <br />land administered by the Bureau of Land Management. <br />We were surprised that although a copy of our letter was included in the pocket of materials <br />which we received, it was not designated as an exhibit in the application and there was no <br />mention of this conflict in land ownership in the copy of the minutes of the Boord meeting. <br />Since there is a cloud on the title, I am concerned that the tract was not excluded from the <br />permit. <br />I am including herein a copy of your Exhibit 1 d on which I hove outlined the parcel of land <br />which according to our records is public land. As such, regulations require that a contract be <br />obtained from the BLM for that portion of the permit. <br />If you have any questions or wish to discuss this matter in more detail, please coil our Geologist, <br />Charles Fair, at (719) 275-0631.
