Pendleton <br />RE: WEST ELK C,OAC COMP S RESPONSE TO STIPULATION N0. 14, UPPER WASTE <br />PILE PE T N <br />Pursuant to your request, I have reviewed Anaconda Minerals Company's <br />submittal, made on behalf of West Elk Coal Company, in response to Stipulation <br />No. 14 placed upon approval of the Mt. Gunnison No. 1 Mine's Upper Waste Pile <br />Permit Revision. This stipulation required the completion of a plan to <br />install tiltmeters downslope from the toe of the proposed upper waste pile. <br />The applicant proposes the installation of two Slope Indicator Company <br />slot-tracked PVC pipe inclinometer tubes. The type and locations are <br />acceptable as proposed. <br />Paragraph four the the submittal letter addresses the frequency of monitoring <br />of the tiltmeters and is unfortunately confusing. I suggest that the operator <br />resubmit the letter with paragraph four rewritten as follows: <br />"The inclinometers will be installed in bedrock. During <br />angering activities to install the inclinometers, the <br />cuttings will be logged to determine the depth of bedrock. <br />The inclinometers shall be read initially before the <br />placement of any waste coal materials. During the first year <br />of waste pile operation, the inclinometers shall be read <br />monthly. After the first year of operation, the frequency of <br />inclinometer readings shall be amended. Beginning in the <br />thirteenth month after deposition of the first waste coal <br />material in the structure, the tiltmeter monitoring schedule <br />shall consist of readings taken in January, April, May, June, <br />July and October.
