The next area to be mined is the portion of Phase II that lies
west of the Phase I pit and south of the Intermittent Ditch. Your operation appears to be in conformance with the
approved mining plan, and moving into the next mining phase does not require a revision to the permit.
You stated that the north, east and south slopes of the Phase I pit were sloped as they were mined, presumably
because they are in their final locations. Can you clarify whether the gradient of those slopes is the gradient
required in the final reclamation plan? If so, that reclamation cost may be removed from the bonded liability. I will
calculate the total bond amount, but will also review the cost figures provided with your letter. I will send the
revised bond amount soon, under separate cover. Please be reminded that upon notification of a bond increase, an
operator has 60 days to provide the necessary additional bond.
Thank you for the information. If you have additional questions, I may be reached at the Division's Durango field
office: 701 Camino del Rio, Room 125, Durango, CO 81301; telephone 970-247-5193.
Sincerely,
Bob Oswald
Environmental Protection Specialist
Ec: Bruce Humphries, DMg
C:\del norte west phase2 fw/rco
Office of Office of Colorado
Mined Land Reclamation Active and Inactive Mines Geological Survey
