Lory1 <br />Dinsion Director <br />The Division has reviewed your April 7, 1993 correspondence <br />regarding the Golden Eagle Mine. In your letter, you have <br />requested that the Division take three actions against the Golden <br />Eagle permit. These three actions are to 1) require Basin <br />Resources to show cause as to why the reclamation bond should not <br />be raised in order to protect the value of surface improvements <br />and water supplies; 2) require Basin resources to show cause as <br />to why the Golden Eagle permit should not be revoked; 3) Convene <br />a formal review by the Board pursuant to 34-33-124. <br />The Division has become aware of irregularities regarding the <br />subsidence requirements and related compliance issues at the <br />Golden Eagle Mine. We have initiated an investigation into the <br />permit documents on file with the Division, and have begun to <br />research the mine files as well in order to ascertain which <br />provisions of the Act or the Coal Mining Regulations may have not <br />been complied with. During this review, we are evaluating the <br />specific allegations raised in your correspondence. We <br />anticipate that our review will be concluded by the end of May, <br />1993. At the conclusion of our research, we will issue <br />appropriate enforcement actions as necessary to Golden Eagle in <br />order to compel compliance with the Act if compliance is not <br />being maintained. We will provide you with the results of the <br />investigation as they are finalized. <br />I would like to take this opportunity to address each of the <br />three requests for relief which you have requested. Our view of <br />the requests which you have made is that they are valid, but are <br />somewhat premature in that no determination of non-compliance has <br />been made as yet by the Division. <br />
