(b.l This right of access shall be non-exclusive and subject [o [he use of the <br />Mountain Coal lands by Mountain Coal, its assigns, agents, and lessees. Any lessee and Mautz <br />shall not interfere with each other. <br />(c.) Such improvements or maintenance to said access as may be required by the <br />County or State, may be conducted by Mautz upon written approval by Mountain Coal. <br />(d.l Mountain Coal further agrees to construct a gate at the point where the Lone <br />Pine Gulch road begins at the western boundary of the Mountain Coal lands at Highway 133 as <br />further designated on the map attached as Exhibit A. Access through this gate shall be controlled <br />by Mautz, Mountain Coal, and Mountain Coal's lessees in a manner mutually agreeable to Mautz <br />and Mountain Coal. <br />(e.) This right of access shall be for a term of five years from the dale of this <br />Agreement or until Mountain Coal or Mautz transfers their lands to a third party, whichever occurs <br />earlier.
