L.r~~„vr °nro~, <br />4901 South Windermere Street M¢har~ a Lnnp <br />Littleton, Colorado 80120 D1v1i1on °ieCOr <br />Re: Rimrock Coal Mine (C-89-074); Permit Condition to Resolve Outstanding Civil <br />Penalties <br />Dear Mr. Ken: <br />The Division has imposed a permit condition upon the Rimrock Mine permit, CDMG <br />permit No. C-89-074, as a result of a recommendation obtained through the Applicant <br />Violator System. The AVS indicates a link between owners of Landmark Reclamation, Inc. <br />and outstanding civil penalties issued to coal mines in Oklahoma in 1982. <br />This permit condition shall require: <br />Rimrock Coal Company, Landmark Reclamation, Inc., or other persons responsible, <br />shall pay by August 17, 1995, outstanding civil penalties identified in the Applicant <br />Violator System, or demonstrate prior to August 17, 1995 that Landmark <br />Reclamation, Inc. and Rimrock Coal Company are not linked to the entity in <br />Oklahoma responsible for payment or did not have control of the mines in Oklahoma <br />at the time the violations were issued. <br />Failure to comply with this permit condition will result in a violation of requirements of the <br />permit.
