<br />.. <br />XXIII, S eciap 1 Categories of Mining other than AVF and Prime Farmland - <br />u es an <br />At the King Coal Mine, there are no concurrent surface and underground mining <br />operations (Rule 4.22), no auger mining (Rule 4.23), no mountaintop removal <br />(Rule 4.26), and no in-site processing (Rule 4.29). Therefore, the <br />requirements of these sections are not applicable. <br />The original findings document (February 4, 1982) stated "...the portal bench <br />areas of the King Coal mine constitute steep slope mining areas" (Rule 4.27). <br />Stipulation No. 2 within this original findings document required National <br />King Coal to prepare a geotechnical and stability analysis of these areas. A <br />report entitled "Geotechnical and Stability Analysis, Proposed Backfill <br />Configurations, King Coal Mine" was submitted on August 23, 1982 by Mr. Fred <br />Johnson, consulting geologist. This report was received and accepted as <br />satisfying this stipulation by the Division as addressed in an October 5, 1982 <br />correspondence. <br />The operation is in compliance with the requirements of this section. <br />XXIV, Miscellaneous Compliance - Rule 2.05,6(5), 4.02, 4.12, 4.19, 4.21, <br />, an <br />As this is an underground mine, the requirements of Rules 2.05.6(5), 4.12 and <br />4.19 are not applicable. National King Coal does not propose to do any coal <br />exp]oration (Rule 4.21) nor does it have any coal processing plants or support <br />facilities not located at or near the mine site or not within the permit area <br />for the mine (Rule 4.28). No problems were identified pertaining to signs and <br />markers (Rule 4.02) or to cessation of operations (Rule 4.30). <br />The operation is in compliance with the requirements of this section. <br />XXV. Operations on Land Subject to Limitations or Prohibitions - <br />.. e~ ~~ <br />The Division hereby makes the following five findings pertaining to the <br />proposed operation. <br />1. The permit area is not within an area designated unsuitable for mining. <br />2. The permit area is not within an area under study for designation as <br />unsuitable for mining. <br />3. The permit area is not within any lands subject to prohibitions or <br />limitations addressed under Rule 2,07.6(2)(d)(iii), <br />4. The permit area is not within 300 feet, measured horizontally, of any <br />occupied dwelling. <br />-24- <br />
