<br />II. Land Use - Rules 2.04.3, 2.05.5 and 4.16 <br />Information pertaining to land use is presented in Section 2.04.3 of the <br />permit application. Information pertaining to the proposed post-mining land <br />use is found in Section 2.05.5 of the permit application. <br />The historical usage of the Hay Gulch area is varied. The bottomland areas <br />have typically been used to grow hay crops whereas the native upland regions <br />have been used for cattle grazing and wildlife habitat. Numerous abandoned <br />coal mines dot the gulch uplands where several coal seams outcropped. <br />National King Coal proposes to reclaim the disturbed acreage, excluding the <br />combination haul/access road, to the primary use of rangeland with a secondary <br />use being wildlife habitat. The combination haul/access road will remain for <br />access to the site as requested by the landowner, Mr. Lawrence Huntington. <br />National King Coal is not proposing any alternative land use but a restoration <br />of the area to its pre-mining land uses. <br />The Division finds, pursuant to Rule 2.07.6(2)(1), that the proposed <br />post-mining land use of the permit area meets the requirements of Rule 4.16. <br />The operation is in compliance with the requirements of this section. <br />III. Cultural and Historic Resources - Rules 2.04.4 and 2.05.6(4) <br />Information pertaining to cultural and historic resources is presented in <br />Section 2.04.4 of the permit application. <br />For the five-year renewal period, National King Coal is not proposing to <br />disturb any new surface areas. Therefore, the survey performed for the <br />original permit term is still applicable. <br />A survey of cultural resources was performed by Jamie A. Karl son, Staff <br />Archaeologist, Fort Lewis College. This survey did not identify any cultural <br />resources eligible for the National Register of Historic Places. <br />National King Coal also obtained a letter, dated March 4, 1980, from the State <br />Historic Preservation Officer pertaining to a file search of their records. <br />No known sites eligible for the National Register of Historic Places were <br />identified. <br />Based upon a review of the information provided in the permit application, the <br />Division finds that the proposed mining operation will not adversely affect <br />any publicly owned park or place listed on the National Register of Historic <br />Places. <br />The operation is in compliance with the requirements of this section. <br />IV. Geology - Rules 2.04.5 and 2.04.6 <br />National King Coal has supplied geologic information pertaining to the <br />proposed operation and adjacent area. This information may be reviewed in <br />Sections 2.04.5 and 2.04.6 of the permit application. <br />-6- <br />
