CO 80203-2273 <br />RE: Spoil Monitoring at Seneca II Mine <br />Dear Mr. O'Connor: <br />This letter is a follow up to conversations I have had <br />with Steve Renner concerning the installation of spoil <br />wells at the Seneca II Mine. Some surprises were <br />encountered during the spoils drilling program at the <br />Spring Creek and Cow Camp Creek sites. Rather than <br />clustering wells unnecessarily close, because eight spoils <br />wells were committed to, I recommended and Steve agreed <br />that two spoils wells could be reserved far the Bond Creek <br />drainage. Though this will postpone the drilling of the <br />final two wells a few years, the spoil well drilling this <br />summer has satisfied the time dependent commitment to the <br />Seneca II Permit Renewal. <br />It is our understanding that the above interpretation is <br />correct. If you should have any questions regarding this <br />agreement, please contact me at once.
