The utilization of these rights shaII include rights of access to water sources and storage facilities as are made available under thts Agreement as provided in sub-paragraph (a) above. h. COM, INC. shall make such use of the rigkits granted here- under as are reasonably required and for the purposes apedfied and shall not overburden the land beyond that which is necessary nor unreasonably interfere with any of the uses of MI VIDA. 8. The parties are not nos in agreement as to diverse matters governing their respective interests in and to certain properties out- side the scope of this Agreement. As to those matters, the parties agree only that they aze currently is disagreement. The execution of this Agreement is not intended to resolve those disputes or to accomplish either an explicit or implicit waiver or release of respec- tive claims, causes of action or negotiating posittons. b. This Agreement may serve as the basis for negotiating a resoluttoa of unresolved disputes, however, the parties are here expressly declaring this Agreement is not to be construed as any resolution or compromise of any claims or agreement to execute any further or future agreements. 9. Insp~on of Mill a, COM, INC. shall allow a reasonable number of designated employee(s), visitors or agents of bII ~A to over-look muting opera- tions when MI VIDA's ore is being crushed, milled, tabled. concen- trated. filtered, dried or loaded. 9
