During <br />times of a senior call, out-of-priority diversions under the new iunior <br />right will be replaced as necessary by foregoing diversions under the Lone <br />Tree Poultry right up to the estimated historic consumptive use of 24 <br />acre-feet for this right. The total dally depletion for Lone Tree Creek <br />from the mine is the sum of water lost to dust control, pond evaporation, <br />and aggregate removal. The daily depletion can be estimated based on the <br />following formula: <br />Daily depletion (AF/day) _ <br />Gallons used for + Average dally net + Tons of aggregate removed <br />dust control evaporation for the times a factor of 0.000015 <br />325,900 month (A F) <br />Land historically irrigated with the Poultry right will not receive any <br />supply from diversions under the Poultry right. This land is located <br />within the mine property and will be mined according to the mine plan for <br />the gravel pit. <br />It is anticipated that senior calls on the new Junior right will primarily <br />be from the Giffin Reservoir rights. The water rights for Giffin Reservoir <br />are the controlling rights in the Upper Lone Tree basin; the only other <br />intervening right between the Giffin Reservoir rights and the proposed mine <br />is the Lone Tree Creek right for 0.11 cfs and will likely be satisfied by <br />seepage and return flows in the creek. This is consistent with the historic <br />and likely future administration of water rights in the Upper Lone Tree <br />Creek basin. The Lone Tree Poultry right is senior to both the Giffin <br />Reservoir rights and 0.11 cfs Lone Tree Creek right.
