' INTRODUCTION
1 This amendment to a Conditional Use contains three changes to
the existing operations plan approved by Adams County. We have
' separated each requested change into a different section of this
submittal so each can be reviewed on it merits and so there will
be no confusion as review is completed for each change.
' The first and most important is a temporary change in the
hours of operation from, 6:00 am to 10:00 pm, to 24 hours from the
' approval date of this change to September 1, 1992. Our Lessee,
Aggregates, Inc. has until May 15th, 1992 to deliver 771,300 tons
of rock to the new Denver Airpott. They are not physically able
to deliver this material in that time period without running 24
' hours per day until the orders are filled.
The second part is a minor change we have made to the mining
' plan originally submitted. The change was to removed the staging
plan from the maps, increase the area to disturbed at one time and
increase the amount of the MLRB reclamation bond. This part of
the submittal consists of a revised Mining Plan Map, Reclamation
' Plan Map and copies of the Technical Revision submitted January
30th, 1992 to the Colorado Minded Land Reclamation Division.
' The third change is to extend the use of the existing
Concrete Batch Plant for the life of the Sand and Gravel Mine.
This Plant has been operated by our company since 1979 at this
site under a Special Use Permit, # A-82-79, renewed in 1985. In
1985 when the last extension was granted we were told the Condi-
tional Use would have to be amended to continue to operate the
' plant. The plant has become a vital part of our operation in
Adams County and denying its continued operation would place a
large financial hardship on us. In addition local citizens have
become used to having a ready source of concrete for local
projects so close. Removal now would cause an undue hard-ship on
this company. The arguments valid in 1984 when the Special Permit
was renewed are still valid today. In addition a number of our
' competitors have or are applying for installation of Concrete
Batch plants at their gravel mining operation and that would give
them an unfair advantage in the market place.
