Shelton <br />Dlrector <br />October 1, 2981 <br />Re: CORTEZ PIT AND DECOKES RIVER PIT <br />Our File Nos. 7 ~59 and 77-2, respectively <br />Dear Mr. Conger: <br />I have received and reviewed the materials you sent to the Division concerning <br />my inspection reports on the above captioned operations, as well as the annual <br />report (with the $350.00 fee) for the Cortez Pit. I have some comments <br />concerning both pits. <br />The annual report for the Cortez Pit is clear and adequate under the terms of <br />the Mined Land Reclamation Act. Z also feel that my questions outlined in <br />the inspection report of August 28, 1981, and my letter of September 3, 1981, <br />have been adequately answered. j, <br />I have also reviewed the situation concerning the Delores River Pit. The <br />existing bond of $42,000.00 does not seem excessive, considering that this <br />is now a I4I acre operation. However, should you wish to•make a formal request <br />to the Board for reduction of this bond, please do 50, giving an exact figure <br />to which you wish it to be reduced and justifications for this figure, and <br />it will be considered. No such exact figure was given in your letter of <br />September 2, 1980. <br />Furthermore, since the final disposition of this site as far as a reservoir <br />is concerned bears so directly on the reclamation (and bonding) of the site, <br />there should be verification of and a timetable for this final land use by <br />the Bureau of Reclamation in our file. This was to be submitted as a part of <br />the amendment that enlarged the pit (submitted On June 13, 1980). The COVer <br />letter to this amendment stated: "A statement from Bureau of Reclamation <br />regarding scheduling of the Delores River Project will be sent under separate <br />cover". No such statement has been received by the Division. This statement <br />is necessary to justify the lack of topsoil salvage on the site as well as <br />any changes in the bond.
