Civil penalty of $2,750.00 paid 1/23/98 <br />NOV CV-99-004 <br />- Issued for failure to construct the permanent coal mine refuse pile according to the <br />Regulations and the approved plan <br />-Issued 4/15/99 <br />- Terminated 7/08/99 <br />-Civil penalty of $750.00 paid 8/31/99 <br />Section Ill -Reclamation Liability <br />The Division conducted a complete review of the reclamation liability for the Bowie No. 2 Mine in <br />June 1999, as part of the adequacy review for Permit Revision No. 3. With the approval of Permit <br />Revision No. 3, the reclamation bond liability will increase to $4,882,041.00. In anticipation of the <br />approval of Permit Revision No. 3, BRL submitted a rider to their cotporate surety, raising the bond <br />held by the Division to $5,000,000.00. <br />The bond document history is as follows: <br />Original bond of $4,200,000.00, corporate surety bond number 400JT7032, issued through St. <br />Pau] Fire and Marine Insurance Company. <br />2. Replacement bond of $4,200,000.00, corporate surety bond number 113701, issued through <br />Frontier Insurance Company. <br />3. Increase in bond to $5,000,000.00, rider to corporate surety bond number 113701, issued <br />through Frontier Insurance Company. <br />Section IV - Adeauacv Review <br />Because of the recent revisions for the Bowie No. 2 Mine, the petmit application has been kept up to <br />date. The Division has only one adequacy review comment: <br />Please provide hydrology and sedimentology designs for the small area exemptions (SAE's) at <br />the mine site that demonstrate that the disturbed area runoff from the SAE's can meet effluent <br />limitations.
