RAPE <br />VIA REGISTERED MAIL <br />Mr. Duane Woodard <br />Attorney General <br />State of Colorado <br />1525 Sherman Street <br />Third Floor <br />Denver, CO 80203 <br />Dear Mr. Woodward: <br />Please be advised that this office has been retained by Mr. and <br />Mrs. Dale Ackerman to represent them on all claims they may have <br />against the Department of Natural Resources, Mine Land Reclamation <br />Division, State of Colorado; the Colorado State Patrol, State of <br />Colorado; the Colorado Highway Department, State of Colorado, and <br />any other responsible parties for damages resulting from an <br />incident which occurred on March 20, 1987. The incident in <br />question involved a motor vehicle accident. Mr. Dale Ackerman <br />was the operator of a Euclid RD-50, end dump refuse haulage truck <br />which came into contact with the overpass structure for an <br />overland conveyor belt at a location approximately 1.7 miles east <br />of the Western Fuels-utah. Inc. preparation plant where the <br />overpass structure crosses a portion of Rio Blanco County Road 78 <br />in Rio Blanco County, Colorado. As a result of the contact <br />between the truck and the overpass, the truck rolled over and Mr. <br />Ackerman sustained serious physical injuries including the loss <br />of a leg. This letter shall serve as notice pursuant to the <br />provisions of C.R.S. 24-10-109 to the Department of Natural <br />Resources Mine Land Reclamation Division, State of Colorado; the <br />Colorado State Patrol, State of Colorado; the Colorado Highway <br />Department, State of Colorado of Mr. and Mrs. Ackerman's claims <br />for damages as a result of the accident Mr. Ackerman sustained. <br />1. Name and Address of Public Employee Involved: Those State <br />employees known to the Claimant at this time may include those <br />individuals who would be responsible for review, approval, or <br />inspection of the design and/or installation of the overpass for <br />the coal conveyor belt which crossed County Road 78 in Rio Blanco <br />
