4.3 APPENDIX C -BLM PROPOSED MITIGATION <br />The following mitigative measures and stipulations will <br />be applied by BLM to the approved action, regardless of <br />the alternative selected. Some measures aze unique to specific <br />alternatives and are duly noted. <br />All of the following stipulations Gave been developed <br />as the result of a comprehensive, interdisciplinary <br />environmental analysis and technical evaluation of WRC's <br />five volume mine plan, numerous tr~hnical reports, and <br />various information submittals. These; stipulations, which <br />will be applied to the approved action, represent the <br />minimum amount of mitigation deemed necessary, at this <br />point in time, in order to ensure compliance with WRC's <br />sodium lease terms, which explicitly require protection of <br />groundwater and oi! shale resources. It is important to note <br />that many of these stipulations, especially those within <br />Sections 4.3.4, Well Drilling, Completion, and Abandon- <br />ment; 4.3.5, Monitoring; and 4.3.6, Submittals, are <br />contingent on, and may change based on data obtained <br />during the experimental pilot-scale project and early stages <br />of the commercial-scale project. The Bexibility to change <br />and/or revise stipulations, especialYy those operational <br />stipulations within the above referem:ed sections that deal <br />with technical and environmental uncertainties, is essential <br />because of the innovative, unproven nature of the technology <br />WRC will be employing, and BLM's responsibility for <br />prudent management of the public lands. Thus, the identified <br />operational stipulations may be mcdified as monitoring <br />results indicate opportunities/needs for revision, so long as <br />the mitigation objective is still met (i.e., impacts are mitigated <br />as intended in the EIS impact analysis sectior and/or by <br />the lease terms). <br />Any approval of a commercial-scale production <br />eltemative will contain a statement clearly specifying that, <br />due to the nature of the technology to be employed, <br />environmental impacts will be closely and carefully <br />monitored. In compliance with the terms and conditions <br />of the sodium leases and mitigation developed in this EIS, <br />should this continuous monitoring indicate that significant <br />impacts are occurring which were not anticipated in this <br />E[S, the project will be shut down. BLM will then reassess <br />the project, given the monitoring results, and determine <br />whether additional mitigation will alleviate the impact or <br />whether the project cannot be allowed to resume <br />development. <br />4.3.1 General <br />If additional construction material is necessary for <br />development associated with the approved action, the <br />designated operator/lessee shell submit an application to <br />the authorized officer for authorization to obtain such <br />material, if located on public lands. <br />The designated operator/lessee shall locate, handle, and <br />store gas, oil lubricants, and other petroletrm products in <br />such a manner so as to prevwt them from entering into <br />and contaminating water resources and soils on the public <br />lands. <br />The United States of America considers the development <br />of groundwater resouroes to be necessary and frequendy <br />indispensable to effective land management. The United <br />States shall have the fast opportunity to file a state water <br />right for any intercepted groundwater. The designated <br />operator/lessee may file for water rights within the lease, <br />only with a written waiver from the District Manager. The <br />Bureau of Land Management concedes the existence of any <br />water rights that the Wolf Ridge Corporation and its affiliates <br />may own or control before the date of approval of this <br />mine plan. <br />The authorized officer shall be contacted at least 24 hours <br />prior to: <br />1. Surface disturbing construction or maintenance activity <br />2. Commencement of reclamation activity <br />3. Commencement of drilling and logging operations <br />Rightsof-way will be required for the off-lease portions <br />of ancillary facilities covered under the approved mine plan <br />pursuant to Title V of FLPMA and Section 28 of the Mineral <br />Leasing Act of 1920, as amended. <br />4.3.2 Air Quality <br />Periodic watering of the access roads, well field roads <br />and plant site will be carried out to control fugitive dust <br />emissions. This stipulation wdl apply particularly from May <br />through October. The authorized officer may direct <br />additional treatment of the road, as deemed necessary. <br />For the 500,000 TPY Alternative, fabric filtration shall <br />be utilized for the additional materials handling steps of <br />bulk product packaging and truck loading. A baghotue or <br />electrostatic precipitator and flue-gas desulfurvation shall <br />be applied to the coal-fired boilers. <br />4.3-1 <br />
