Page 2 <br />Operational Plan was for 10 to 20 years (not a temporary). The <br />State plan is for the lifetime of the mine, to make a different time <br />limit would be in conflict with the State, such as 3 to 4 years. <br />Megen stated that we were getting close to an agreement and that <br />she would draw up another set of Plan of Operations and leave <br />extra spaces for clarification and objections and when she sent the <br />plans to us it did not correspond to the meeting, we filled it out <br />anyway with objections, signed it and returned it on a timely basis <br />08/05/01- As of yet we have had no response and to reiterate this <br />document was signed under protest. <br />South Park Ranger District has created situations that have <br />involved many agencies- FS personnel initiated the involvement <br />not Topaz Mountain Gem Mine. <br />As follows: <br />(1) National Forest <br />(2) BLM <br />(3) Federal Mining Laws- Claimant's rights <br />(4) State Mining Laws -Claimant's rights <br />(5) Mine Land Reclamation <br />(6) State Range Law <br />(7) Park County Code <br />(8) Park County Environmental Health <br />(9) State Environmental Health <br />(10) State Water Board <br />The State has control of the water. The agreement I have with the <br />State and supposingly with the National Forest that all water needs <br />to be returned to aquafer - to be practical it would have to be <br />processed first with the approval and design of a septic engineer. <br />It appears that to haul the water off is for recreational camping not <br />for an operational mine where the water is coming from an on site <br />
