C-81- <br />In response to your request, I reviewed the response submitted by ACZ, Inc, <br />consultant to Rock Castle Company. This submittal responds to Stipulation No. <br />2 placed upon the Grassy Gap Mine Permit, which required that the operator <br />develop and implement a plan to render the road cut landslides stable. ACZ, <br />Inc. presents a report which identifies the landslide areas and proposes <br />various engineered stabilization techniques for each of the affected areas. <br />The analytical and design techniques applied and the assumptions made are <br />acceptable. The consultant has done an admirable job of responding to the <br />task. In my opinion, all of the proposed remedial landslide treatment plans <br />are approvable. <br />The submittal includes a coverletter by Robert Sherman, Representative of the <br />Rock Castle Company. Mr. Sherman requests that the company be allowed to <br />forego implementing the recommended remedial treatment for landslide area <br />No. 3. Landslide area No. 3 is estimated by ACZ, Inc. to include 302,400 tons <br />of earthen material, roughly twice the total tonage of the other 10 landslide <br />areas combined. Mr. Sherman proposes to monitor the landslide, in order to <br />determine if it might stabilize itself without requiring remedial treatment. <br />In my opinion, there is nothing I have observed at the Grassy Gap Mine site, <br />nor anything included within the consultant's report, to indicate that <br />landslide No. 3 will stabilize itself with time. I suspect it will werely <br />continue to increase its disturbed area and potentially increase its level of <br />hazard. Therefore, I recommend that Mr. Sherman's request be denied. <br />Further, I recommend that Rock Castle Company be required to propose a <br />schedule for affecting the remedial treatment of the various landslides at the <br />Grassy Gap Mine site.
