The lessee shall submit a permit revision application to Colorado Mined Land <br />Reclamation Division and a resource recovery and protection plan modification to BLM <br />that reflects any changes in the mining and reclamation plan caused by the suspension. <br />5. This suspension may be extended upon a showing that the conditions warranting the <br />suspension still exist. An extension will be considered if application is made before <br />expiration of the eight-year term. <br />6. This suspension shall terminate upon: <br />a. The date beneficial use of the lease recommences; or <br />b. The date the situation determined to be in the interest of conservation ceases; or <br />c. The date that annual recertification of continuing conditions is due but has not <br />been filed by the lessee; or <br />d. October 2, 1998, whichever occurs first. <br />Failure of the lessee to notify the State Director, Colorado, of a change in status of the <br />suspended lease or to certify a continuing need for the suspension will result in the <br />immediate termination of the suspension. <br />You have the right to appeal this decision to the Interior Board of Land Appeals <br />(1BLA), Office of the Secretary, in accordance with the regulations contained at 43 CFR <br />Part 4, and the enclosed Form ]842-]. If an appeal is taken, your Notice of Appeal must <br />be filed in this office so the case file can be transmitted to the IBLA. A copy of your <br />Notice of Appeal and of any statement of reasons, written arguments, or briefs must also <br />be served on the Office of the Solicitor as shown on Form 1842-1. It is also requested <br />that you send a copy of any statement of reasons, written arguments, or briefs to the <br />office issuing the decision appealed.
