(EFCI) concerns <br />about the GEC reclamation project and resulting impacts on our adjacent <br />permit area. The area of concern includes the reclaimed "West Slope" above <br />and adjacent to EFCI's Magpie Creek Diversion. <br />The Division's reclamation efforts thus far on the West Slope area have <br />resulted in regrading the slope to approximately 3H:1V sideslopes and <br />eliminating the pre-existing access road/ diversion ditch at the base of <br />the slope running to the "West Pit" sediment pond. EFCI understands that <br />the Division has no plans to reestablish any drainage diversion along the <br />regraded slope. <br />The planned West Slope reclamation will result in increased surface runoff <br />from a large redisturbed area directly onto EFCI's permit area and into <br />the Magpie Creek Diversion. This portion of our permit area, and the <br />permanent diversion, are constructed on fill material and are e:ttremely <br />prone to water erosion. You observed these conditions during your <br />inspection with Ms. Shawn Smith on February 28, 1994. <br />EFCI anticipates that the West Slope reclamation work will adversely <br />impact Magpie Creek Diversion by increased erosion of diversion inslopes <br />and channel, and increased sediment load. These impacts will certainly <br />result in more maintenance of the area with the increased potential of <br />regulatory compliance issues. EFCI is considering a revision to our permit <br />to exclude the portion of Magpie Creek directly impacted by the GEC/ East <br />Pit Reclamation Project. <br />EFCI would welcome the opportunity to further discuss these concerns with <br />the Division while the GEC work is still in progress.
