("Schmalz"). Schmalz is the holder of MLRB Permit M-85-023 issuE <br />with the mining operation at the Hollenbeck Pit, located 6 miles ea: <br />Colorado, in W1/2 SE1/4 of Section 11, T.49N, R1E, N.M.P.M. Though <br />the permit, it is no longer the operator of the Hollenbeck Pit. Despite nun <br />and demands, Mr. Hollenbeck has failed and or refused to substitute hims <br />license and bonding requirements. <br />It is our understanding that Mr. Hollenbeck is currently <br />Hollenbeck Pit and supplying materials, in particular to Gunnison Coui <br />Construction. It is further our understanding that there are and continue t <br />violations of the applicable rules, regulations and standards governing of <br />Hollenbeck Pit. Of particular concern is the sale to various aarties of mai <br />for the reclamation of the permitted area. <br />Because of these violations and the potential for correspondin <br />fines, Schmalz demands that Mr. Hollenbeck immediately suspend all op <br />Hollenbeck Pit, except for the clean-up and other remediation required by <br />Minerals and Geology. At this time, Schmaltz has no choice but to procei <br />the permit and reclaim the permit area.
