Memo to PCPC • •
Re: SUP No. 1999-007
5/11/2001
Page 5
12. Special Use Permit No. 1999-007 shall be placed on a one-year review.
NOTATION: Section 36(1) of the Pueblo County Zoning Resolution provides that the action
or activity authorized by a special use permit must be exercised in full or construction
started within one year of the date of the Planning Commission's approval or the special use
permit becomes null and void unless the permit is extended by the Commission. Further,
the action or activity must be in full compliance with all conditions of the special use permit.
Please note that merely obtaining necessary building permits, other local, State, or Federal
operating permits, and entering into agreements does not constitute an exercise in full or
starting construction.
AGENCY COMMENTS
Janet Kuzmiak, Well Commissioner, Division 2, indicated in a memo submitted to this
Department May 7, 2001, that as long as the gravel mine is operated in accordance with the
approved Substitute Water Supply Plan (SWSP) the Division has no objection to the operation.
OPPOSITION
As of the date of this review, staff has not received any written opposition regarding the current
permitted activity.
STAFF COMMENTS
Staff toured the site May 11, 2001 with the applicant's representatives, and observed the
mining operation has commenced (Exhibits 6a-b). Mining activity in Phase I uncovered
substantial scrap metal from an old dump, and clay deposits. Phase II of the operation is
progressing rapidly.
2. The applicant has submitted required copies of approved plans and permits to this
Department, and appears to be in compliance with all conditions of approval. Therefore,
staff will recommend this permit be reviewed on a complaint basis, with revised conditions
of approval.
Attachments: Exhibit 1
Exhibit 2
Exhibit 3
Exhibit 4
Exhibit 5
Exhibit 6a-b
Letter of Request, d. 5/7/99
Vicinity Map
Pre-Mining Plan Map, d. 5/6/99
Mining Plan Map, d. 2/25100
Reclamation Plan Map, d. 5/6/99
Photos
c: Eric Reckentine, Land Manager, LaFarge, Inc,
Rusty Cochran, Operations Manager, LaFarge, Inc.
Steve Burnside, Aggregate/Asphalt Manager, LaFarge, Inc.
C.R.
