Memo to PCPC • • <br />Re: SUP No. 1999-007 <br />5/11/2001 <br />Page 5 <br />12. Special Use Permit No. 1999-007 shall be placed on a one-year review. <br />NOTATION: Section 36(1) of the Pueblo County Zoning Resolution provides that the action <br />or activity authorized by a special use permit must be exercised in full or construction <br />started within one year of the date of the Planning Commission's approval or the special use <br />permit becomes null and void unless the permit is extended by the Commission. Further, <br />the action or activity must be in full compliance with all conditions of the special use permit. <br />Please note that merely obtaining necessary building permits, other local, State, or Federal <br />operating permits, and entering into agreements does not constitute an exercise in full or <br />starting construction. <br />AGENCY COMMENTS <br />Janet Kuzmiak, Well Commissioner, Division 2, indicated in a memo submitted to this <br />Department May 7, 2001, that as long as the gravel mine is operated in accordance with the <br />approved Substitute Water Supply Plan (SWSP) the Division has no objection to the operation. <br />OPPOSITION <br />As of the date of this review, staff has not received any written opposition regarding the current <br />permitted activity. <br />STAFF COMMENTS <br />Staff toured the site May 11, 2001 with the applicant's representatives, and observed the <br />mining operation has commenced (Exhibits 6a-b). Mining activity in Phase I uncovered <br />substantial scrap metal from an old dump, and clay deposits. Phase II of the operation is <br />progressing rapidly. <br />2. The applicant has submitted required copies of approved plans and permits to this <br />Department, and appears to be in compliance with all conditions of approval.
