Foidel Creek Mine <br />As discussed, the Division reconsidered its decision regarding the activities proposed by the US <br />Bureau of Mines at the Foidel Creek mine. Based on the fact that this is an ongoing cooperative <br />project with Twentymi]e Coal Co., we do not feel that an NOI issued to the Bureau would be <br />appropriate for these activities. Information provided by the Bureau indicates that proposed <br />activities would have no impact on the surface. However, it is the responsibility of the pelmittee <br />to ensure that the surface, in particular, the topsoil resource, is adequately protected within the <br />permit boundary. From the standpoint of liability, this decision would be consistent with the <br />current policy regarding ranching activities at reclaimed coal sites. <br />Pond M Permanent Demonstration. Mine 1. Mine 2 and Eckman Park <br />On April 14, 1994, the Division received a letter from Cross Mountain Ranch concerning their <br />desire to retain Pond M on the Mine 2 area as a permanent impoundment. Although this letter <br />is appropriate for these types of actions, the pond should be demonstrated as meeting the <br />requirements of Rule 4.05.9. Permanent Impoundments and processed with the Division as a <br />Technical Revision [o the approved permit.
