Massey: <br />We understand that Dorchester Coal Company is in the process of updating its <br />Colorado Mined Land Reclamation permits to conform to new State regulations. These <br />regulations require special consideration where the permitted operations are <br />within 100 feet of a public road. Dorchester's mining facilities (Fremont County <br />Road 92, 115) and loadout facilities (Fremont County Road 79) both fall within this <br />category. This letter is written to confirm the following: <br />1) Dorchester has obtained the necessary approvals for both the <br />mine and loadout facility from Fremont County, the authority with <br />jurisdiction over the adjacent roads. <br />2) These approvals were obtained by Dorchester through the Fremont <br />County Special Use Permit process. (SUP-81-6, SUP-79-1). This <br />procedure included notice to adjacent lando~mers, public notice _ <br />and ample opportunity for public participation in a public hearing <br />before the Fremont County Commissioners. <br />We hope that the above information is sufficient to meet the current <br />requirements of LMLR. - <br />Sincerely, <br />~:i{.~ _ <br />Gale Decker <br />Fremont County Commission <br />
