R p > <br />,o <br />of <br />o S• <br />ilt~neja/s <br />ep~~p°'~o <br />~Az~+Et~b~ PtrY <br />ivy-X994--~~3 <br />(J"~iJ t-, t7atvdv~ti7"~ <br />CZ ~dG~yt~daj'$ REGD) <br />This fetter contains several informational and record requests to you and to copied members of <br />the San Migue] County Clerk, Planning, Open Space, Environmental Health, and Building <br />Departments, concerning (a) the possible presence and release of mine-tailing related hazardous <br />materials (from the RoanokelSilver Bell mine remediation effort) in the fill used in the wetland and <br />ernbanlanent along the access road into the Pathfinder Gravel Pit, and (b) the staters of efforts to <br />delineate source water protection for the Ames and Lake Fork Junction Area in San Miguel County. <br />1. Fitl Material. <br />Attached to this letter is a copy of a handwritten fax cover sheet (attached as document D-1) <br />sent to Assistant County Plamier Karen Henderson fi-om Melinda D. Nichols of C.D.O.T. dated 5-23- <br />00. The documents faxed (attached as documents D-2, D-3, & D-4) contain information for a <br />Temporary Access Permit for Lee Wymie, Forest Service, and PacifiCorp to use in the Reclamation <br />Project at the Roanoke/Silver Bell Tailings. The letter and Permit Application indicate that hauling of <br />materials (top soil) from Pathfinder Pit to the Tailings will take place over a six week period -between <br />June and August, 2000.The last: docmnent is a map of the Ophir Loop area. At the bottom of the cover <br />sheet (D-1) is a P.S. "Plan to haul materials to Pathfinder Pit." This handwriting, in my opinion, is <br />different from the other writing and clearly resembles that of Karen Henderson's handwriting. <br />I have also included a document (D-5) from C & J Conshuction signed by Rich Benintendi, <br />dated 09-05-00 to Scott Smith. He states thaC topsoil material was hauled from Mr. Smith's Pit to the <br />Ophir Project for PacifiCorp starting July 6, 2000 and completed August 4, 2000. "We made 1875 <br />trips with ten yards trucks for a total of 18,750 cubic yards of top soil." <br />Also attached to this letter is a copy of an Affidavit of Operator (D-6), dated August 29`x', 2000, <br />signed by Scott Smith and notarized, attesting to hauling structural fill material to be used within the <br />permitted boundary, stating that it was "clean of any contaminants" and was placed on the east lane of <br />the Access Road at the fill. The Affidavit does not, however, identify the source of the material. <br />For your convenience, attached is a copy of DMG's Inspection Report, dated 7-24-00, (D-7). <br />The Inspection Date of 7-11-00 is five days after PacifiCorp starting hauling topsoil material from the <br />Pii.
