Court for modif icetion of the automatic stay of 11 U.S.C. { ]62
and, in support thereof, repreeente ea follove:
1. The above-named Debtor filed a petition for relict under
Chapter 11 of the United 6tetes Bankruptcy Coda on November 7,
1990. The Debtor currently serves ee Debtor-Sn-Possession.
2. This Court hne jurisdiction over thle taco pureuent to
2B U.S.C. { 1]74, end thle Sea core proceeding within the meaning
of 28 U.S.C. { 157 (6)(2)(C).
]. On or about Key 7, 1990, Clenton Ciled an action !n the
DSetrict Court of Gregg County, Taxes, 124th Judicial District,
captioned Trecv Glen ClenGOn y C F 6I , Cauca No. 90-977-8
(hereinafter the ^Action^).
4. The Action ie a personal injury action Sn which Clenton
clalme that, while utilizing a defective product manufactured and
marketed by the Debtor, Clanton sustained severe damage to one eye
end has become permanently blinded in that eye.
5. On or about November 21, 1990, coon sal for C.F.bI. filed
e Plea Sn Abe teaent Sn the Action based upon the prowl siona of 11
V.S.C. { ]62.
6. pursuant to Plaintiff's Response to Defendant's Plea Sn
Abatement filed on or about December 19, 1990, Clanton agreed to
look solely to the applicable llebil Sty insurance policy and
C. P. iI.'e insurance tattlers for eatlefection o[ any settlement or
judgment arising out of the Action. Clanton does not seek relief
from the automatic stay for the purpose of pursuing a claim
directly egeinat C. F.LI.
HHEREFORE, Tracy Glen Clenton respectfully requests this Court
to enter ire order modifying the automatic stay ee follove:
1. The eutametlc stay imposed by 11 U.S.C. { ]62 shall be
modified for the purpose of alloying Tracy Glen Clanton to continue
hie action egeinat the above-named Debtor !n the DSetrict Cavrt of
Gregg County, Texas, 124th Judicial Diettlct, captioned Tracy Glen
Clenton v. C.F.iI., Ceuee No. 90-9]7-B;
2. Tracy Glen Clenton shell be limited, horever, t0 recover
only egelnet applicable liability lneurence coverage that yes in
