Issues not <br /> substantively or completely addressed included questions regarding Rollins Sandstone hydrologic <br /> characteristics (study report not finalized), submittal of final air emission permits (not yet received), <br /> updated mule deer winter range map (not received from DOW), statement from owners of powerline <br /> potentially affected by subsidence(statements requested but not received), and update of mine plan map <br /> (long range mine planning not finalized due to recent ownership change). <br /> September 19, 1997 PCC responses to outstanding hydrology issues identified in DMG review letter of <br /> July 30, 1997. Submittal included the report"Hydrologic Characterization of the Rollins Sandstone". <br /> The Office of Surface Mining's Applicant Violator System (AVS) was queried on July 8, 1996 to verify <br /> compliance with Rule 2.03.4, and an "issue' recommendation was received. On July 15, 1997, Powderhom <br /> submitted a Transfer Application changing the operator and permittee from Powderhom Coal Company, a <br /> Colorado Corporation to Powderhom Coal Company,a Delaware Corporation. The system recommendation <br /> of July 28, 1997 resulted in a "Deny" recommendation due to an unpaid civil penaly in the state of West <br /> Virginia. <br /> System checks on September 16, October 27, and November 18, resulted in "Conditional Issue" <br /> recommendations due to six Kentucky civil penalty violations associated with Permit No. 8670201, and three <br /> Virginia CMIS violations associated with Permit No. 2850. All nine violations are currently covered under <br /> 10 <br />
