"Confidentiality: The legislature established specific areas of confidentiality. <br />Perhaps only a mining operator can appreciate the importance of this provision, <br />but its importance is emphasized by the misdemeanor provision for disclosure. <br />The Board should consider this emphasis in its rule making approach and be aware that <br />compliance with current mining and reclamation map requirements disclosing contour <br />lines and cross sections makes the confidentiality concept meaningless since by <br />extrapolation the reserves can be more or less deteryiined. (GSB). <br />17. "Rule-making: No "rule" which would affect substantive rights should be adopted <br />until the opportunity of those governed to be heard has been given.
