McCall, <br />Administrator <br />PUBLIC NOTICE <br />MI NED LAND RECLAMATION BOARD/STATE OP COLORADO, Public Notice in conformance <br />with the Sunshine Administrative Procedures Act, CRS 1973, the Mined Land <br />Reclamation Board will hold a policy-discussion meeting on Wednesday, December <br />14, 1977, at 9AM, in State Capitol, Senate Hearing Room 320-A. The following <br />items will be discussed: <br />1. Stream Alternation Concerns - Division of Wildlife movie. <br />2. Archeological Concerns - Dr. Bruce Rippeteau, State Archaeologist. <br />3. Water Resources Division - statement on underground mire water usage. <br />4. County Topics: <br />Many counties have several so-called "emergency or seldom-used" gravel <br />N/ NN~~~I pits strategically located throughout the county which will be utilized <br />only for emergency road work in the county. The counties feel that is an <br />administrative and financial burden to have to singularly permit all of the <br />~ its in this category. (Trinidad meeting 9/9/77). <br />L) Questions have been raised concerning joint use of gravel pits (private- <br />,~~~county-state-owner). Who is responsible for securing the permit? (TM) <br />~~c) Some counties have stated that the 10-day provisions for the special (111) <br />(l' Pte""" ~ permit are too time-consuming for catastrophy or true emergency situations <br />that demand immediate action. (TM) <br />Is ditch-digging, road building, cut&fill operations and road maintenance <br />all within the road right of ways considered mining? (TM) <br />e) Land levelling -- is it mining or farming? (TM) <br />f) How can the MLR Board commit County Commissioners ten years from now?(TM) <br />g) Can the PII.R Board accept a verbal agreement with the landowner as legal <br />right to enter (i.e., no written submission?). (TM) <br />5. "The relationship between counties and the Mined Land Reclamation Board under <br />existing law in connection with responsibility for controlling reclamation of <br />mined lands. The involvement of counties in the reclamation crocess under the <br />new statute has been confusing and seems to vary from county to county." (JOhn <br />F. "The necessity for legislation to clarify any fees which a county may charge in <br />connection with filing mined land reclamation permit applications with the <br />county clerk and recorder."
